In 2022, legal and political observers witnessed a spate of bizarre pronouncements from ‘learned judges’ at various levels of the judiciary. Taken together, these statements demonstrated and underscored how these judges were drifting away from not only basic social sense and sensibility but also the primary parameters of the official code of conduct, law and rationality. In their urge to express emotions and personal opinions while interpreting the laws, they ended up creating major controversies. Here are some instances listed by The AIDEM Delhi Bureau:November 23, 2022: A live stream from the Patna High Court exposed the extent of casteism in the judiciary. The video showed a judge mocking reservations while questioning a district Land Acquisition Officer, Arvind Kumar Bharti. After adjourning the case to grant time to the parties to file their affidavits, Justice Sandeep Kumar was heard saying, “Bharti ji, reservation par aaye the naukri me kya? (Bhartiji, Did you get you job through reservation?)”. As Bharti replied in the affirmative, a lawyer in the courtroom commented, “Ab to huzoor samajhiyega baat (now your lordship will understand the matter).” Another lawyer and then the judge could be seen making a few more comments targeting Bharti and his caste amid peals of laughter.August 12, 2022: A Kozhikode District Sessions Judge S Krishna Kumar created a major controversy while hearing a bail application in a case under Section 354 (A) (sexual harassment) of the Indian Penal Code. Granting anticipatory bail to writer and social activist Civic Chandran in the sexual harassment case, the judge said: “In order to attract Section 354 A (sexual harassment), there must be physical contact and advances involving unwelcome and explicit sexual overtures. There must be a demand or request for sexual favours. There must be a sexually coloured remark. The photographs produced with the anticipatory bail application by the accused reveal that the complainant herself is wearing dresses which are sexually provocative. Section 354 A will not prima facie stand against the accused.”August 11, 2022: Speaking at an event on challenges faced by women in the areas of science, technology, mathematics and business, Pratiba M. Singh, a Delhi High Court judge, described Indian women as “blessed” because scriptures like Manusmriti give a “very respectable position” to them. The comments drew fierce criticism from women’s rights groups. In a statement, the National Federation of Indian Women, said: “Justice Singh seems woefully ignorant of the pathetic condition of women at large, particularly of women from historically marginalised communities, not just in the Indian subcontinent but across the globe.”June 17, 2022: A Karnataka High Court judge observed in a bail order that it was “unbecoming of a woman to fall asleep after rape”. Justice Krishna Dixit was hearing a case relating to the rape of a 42-year-old Human Resources manager, who was said to have fallen asleep after the rape. “The explanation offered by the complainant _ that after the perpetration of the act she was tired and fell asleep _ is unbecoming of an Indian woman; that is not the way our women react when they are ravished,” the judge had observed. However, following a furore, the judge expunged his controversial remarks.May 25, 2022: The Karnataka High Court gently urged love-struck young people to take parents into confidence while choosing their life partners, failing which they could face karmic consequences. “It is high time for the children to know that the life consists of reaction, resound and reflection. What they are doing to their parents today, they would get back exactly tomorrow,” the Court said in its order, while hearing a habeas corpus petition moved by a woman’s father after she eloped with her boyfriend and married him. Quoting the Manusmriti, the court order said, “Even according to Manusmriti, no person can repay his parents even in 100 years for all the troubles that they go through to give birth to him/her and raise him/her to adulthood. Therefore, always try to do whatever pleases your parents and your teachers, because only then does any religious worship done by you will bear some fruit.”May 11, 2022: In the Delhi High Court’s split verdict on marital rape, one of the two judges stated that “sex between a wife and a husband is…sacred”. While he said “legitimate expectation of sex” is an “inexorable” aspect of marriage, the other said the “right to withdraw consent at any given point in time forms the core of woman’s right to life and liberty.” The bench, however, held that the case raises a “substantial question of law” which requires a decision from the apex court. Under section 375 of the IPC, sexual acts by a man with his wife who is not a minor, is not considered rape.March 26, 2022: A Delhi High Court bench while hearing a plea to initiate criminal proceedings against Union Minister Anurag Thakur and BJP MP Parvesh Verma for “hate speech” during 2020 Delhi riots, said: “If you’re saying something with a smile, then there is no criminality, if you’re saying something offensive, then definitely [there is criminality]. You have to check and balance. Otherwise, I think 1,000 FIRs may be lodged against all politicians during elections.”The case involved speeches by the two BJP leaders during the anti-CAA movement and the Delhi riots that ensued. Thakur had said, “Desh ke gaddaron ko, goli maaro saalon ko (Kill the traitors)”. In his speech, Parvesh Verma had told a rally that the “lakhs of protestors” who have gathered at Delhi’s Shaheen Bagh during the anti-CAA movement would enter their homes to “rape their sisters and daughters and kill them”.February 2022: Justice Pushpa Ganediwala of the Bombay High Court resigned after a series of controversial judgements regarding the interpretation of what constitutes a ‘sexual assault’ under the Protection of Children from Sexual Offences (POCSO) Act. She was denied an extension of tenure as additional judge and also an appointment as a permanent judge of the High Court. Manusmirti, Karma, Casteism, Sexism: Seven Bizarre things that Judges told us in 2022

Until recently, who becomes the Chief Justice of India had been the concern of only lawyers, especially the elite among them. The same is the case with almost all democracies; Pakistan would be the sole exception. Appointments to the judiciary, including the highest court of the land, in all democracies except India and Pakistan, does not evoke any kind of sensation. Judges, by the very nature of their job, require to lead a relatively secluded life. Judges of yore used to wear wigs, symbolising that their identity is of little consequence to their work. In a democracy, the role of the judge is to adjudicate disputes between the parties before him/her, and the implications of their judgements for the public at large are largely incidental. The reason is that in a democracy, only the elected representatives can make laws. Every citizen is symbolically present in Parliament and every law enacted by Parliament is assumed to have their consent. And the executive is accountable to Parliament. But in India, the Parliament does not seem to be the supreme law-maker any longer. Every judgement of the Supreme Court, nay, even every word in a judgement pronounced by the judges, is now considered to be the “law of the land”. Matters which fall exclusively in the realm of governance (for instance, demonetisation, handling of the Covid pandemic, and so on) were all taken over by the judiciary. It is no exaggeration to say that the country is now ruled by judges. Appointments of Directors of the Central Bureau of Investigation, the Enforcement Directorate and the Central Vigilance Commission, and Chairpersons of tribunals, which fall in the domain of the executive, now fall under the province of the Supreme Court. Therefore, the question, who the next Chief Justice of India is, is a matter of importance. The engineered hype on social media and the battalion of soothsayers vying with one another to glorify the incoming CJIs is an indication of the irreparable damage to democracy and its supreme institution, Parliament. <img src="https://strapi.bangalore2.com/uploads/SC_e1666260547336_768x429_a2a202b1d7.png" alt="SC-e1666260547336-768x429.png"> &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;Supreme Court of IndiaI, like many, have been closely observing the performance of the Chief Justice- designate D.Y. Chandrachud from the days of his appointment as the Additional Solicitor General of India. He is erudite and hardworking. And he has authored many outstanding judgments. We see only the bright shining side of the moon. The moon has another side as well. I say this as one who represented thousands of slum-dwellers, who were faced with the threat of demolition of their shanties following the orders of the Bombay High Court, of which Justice Chandrachud was a member. The persecution of the poor started soon after the Maharashtra Assembly enacted the Slum Act in 2004 to give protection to slum-dwellers occupying land for long years. Acting on the Public Interest Petitions of elite non-governmental organisations like the Bombay Environmental Action Group, a bench consisting of Justice Dalveer Bhandari, currently a member of the International Court of Justice, and Justice Chandrachud, passed an order directing the demolition of illegal structures, a majority of them slums being within 50 metres of the Coastal Regulation Zone-1. That meant rendering homeless thousands and thousands of slum-dwellers who had been living in their shanties for many decades. Not one of them a party to the legal proceedings. The elementary principles of justice and basic human rights were thrown out the window. There was no amicus curiae to speak about their rights. The Court heard a battalion of senior advocates representing the NGO, the Central and State Governments, and the Brihanmumbai Municipal Corporation. Following the court order, thousands of homes of the poor were demolished and their personal belongings forcefully confiscated and destroyed so that they don’t set up shanties again. All this in Cuffe Parade, within a radius of 2-3 km of the High Court. In 2010, in Kalwa, Mumbai, when the authorities bulldozed 2000 shanties some of the affected women came to me, along with their infants, some as young as two weeks. As it was a holiday, I took them to the residence of the then Chief Justice, Mohit Shah, to file a petition against the demolitions. We were denied an audience with him and were asked to approach Justice Chandrachud, the judge in charge. He granted me a hearing over the phone and directed the authorities to provide temporary accommodation for a day in a rescue home, to the women who were with me. The case was listed for the next day in open Court. However, the affected women were not granted any relief. They were forced to the streets. It is gratifying to note that the views of Justice Chandrachud have broadened since then. I now see news reports about how he has been batting for human rights and for the underprivileged. I hope he will make use of his high office now to do something concrete to ameliorate the living conditions of the slum- dwellers who constitute 60 per cent of the population of Bombay and to relax the coastal zone regulations in such a way as to make available salt pans for housing – which the government could not do because of judicial interference. That 50 per cent of the collegium falls in the exclusive privilege of the sons and nephews of the former judges of the Supreme Court is a glaring fact that highlights the fact that the collegium system is horribly flawed and is responsible for rampant nepotism, which has resulted in the denial of opportunity to the more eligible but less privileged members of the legal fraternity. Kamaladevi became one of the first women arrested for civil disobedience. She auctioned “freedom salt” at the Bombay Stock Exchange for Rs. 501. On January 26, 1930, she clung to the Indian tricolour during a scuffle with authorities, refusing to let go.Who was this woman bold enough to challenge Gandhi?Born in 1903 in Mangalore, married at fourteen, widowed at sixteen. She remarried—scandalous. She divorced—one of India’s first civil divorces. In 1926, encouraged by Margaret Cousins, she became the first woman to contest a legislative office, losing by just 55 votes. In 1927, she founded the All India Women’s Conference as its organizing secretary.In 1936, she became a founding member of the Congress Socialist Party, working alongside Jayaprakash Narayan and Ram Manohar Lohia. She connected capitalism, imperialism, and women’s subjection: “This imperial capitalist system encourages endless wars and expects women to produce children who become soldiers.” She challenged glorified motherhood itself.In the 1930s—decades before global women’s liberation—she championed bodily autonomy and birth control. Not for population control, but for women’s choice. She traveled to America, worked with Margaret Sanger, and in 1951 established India’s first family planning commission centered on women’s autonomy.She championed what we now refer as feminist economics, preceding the Feminist Care Ethics Debate by decades. She documented sexual division of labor, wage discrimination, and systematic underpayment of women workers in industrial and agricultural sectors—when labor movements barely acknowledged women as workers.Interestingly, she refused the label “feminist,” understanding that in her hostile patriarchal environment, strategic pragmatism mattered. But her ideas? In 1948, she founded and led the Indian Cooperative Union for the rehabilitation of the refugees.Her greatest legacy? Reviving India’s dying crafts as economic empowerment. As chairperson of the All India Handicrafts Board for twenty years, she understood that handicrafts meant livelihoods for millions, grassroots democratic participation, and India’s answer to exploitative industrialization.Her institutions still stand: Indian National Theatre established in 1944, which later became National School of Drama, All India Handicrafts Board established in 1952, Sangeet Natak Akademi in 1953, Crafts Council of India in 1964, and Delhi’s Crafts Museum in 1967. For me, the finest pastime is research and writing, a legacy I proudly inherit from my late grandfather, Shri S.A.A. Rizvi, IAS (Retd.). He was a gold medallist and a remarkable scholar of his times. His query, whether I had ever heard of “Douglas” or “Kinnaird Hospital” of Lucknow was not a passing remark, but a spark that illuminated a forgotten chapter of Lucknow’s medical heritage. His mother, Zahida Auntie, had often spoken of it, pointing to the site near today’s Lari Cardiology Centre, where the geriatric and mental health departments of KGMU (King George Medical University) now stand. Though beset by tragedy, her sister Alice died soon after arrival, and Bielby herself fell gravely ill, the mission still endured. By 1891, through the efforts of Dr. Grace Mackinnon, the Lady Kinnaird Memorial Hospital was established on government-granted land, named after Lady Kinnaird. She was a devout Presbyterian philanthropist remembered for founding the YWCA.&nbsp;<figure class="wp-caption alignnone" style="box-sizing:border-box;display:block;margin:15px auto 10px;max-width:100%;padding:0px;width:416px;" id="attachment_41915" aria-describedby="caption-attachment-41915"><img src="https://strapi.bangalore2.com/uploads/CMS_CRL_IW_1899_08_0007_cropped1_7b434dba61.jpg" alt="CMS_CRL_IW_1899_08_0007-cropped1.jpg" srcset="https://strapi.bangalore2.com/uploads/thumbnail_CMS_CRL_IW_1899_08_0007_cropped1_7b434dba61.jpg 244w," sizes="100vw" width="undefined" height="undefined"><figcaption class="wp-caption-text" style="box-sizing:border-box;display:block;font-size:15px;line-height:20px;margin:0px;padding:12px 0px 0px;text-align:center;" id="caption-attachment-41915">England Zenana Missionary Society</figcaption></figure>In 1910, Dr. Ethel Douglas took charge, and for the next 36 years she transformed the institution, expanding facilities, raising standards, and establishing training protocols that led to the North India Board of Examiners and State Registration Councils. Her dedication earned her the Kaiser-i-Hind Medal in Gold in 1927, and government grants that enabled new wards and modern equipment. As Beth Bullock Spencer’s dissertation records, Douglas’s “extraordinary influence” kept the Lucknow hospital “overflowing,” even as she grappled with challenges ranging from reluctant purdah patients to the infamous monkey menace.“Even the veteran doctor Ethel Douglas struggled to find a solution to the monkey problem, for some of the local people regarded the monkeys as sacred; harming the monkeys was out of question. Douglas resorted to shouting and shaking her rifle at the monkeys, but with little effect.”Snakes, too, were a recurring hazard, and cultural beliefs often complicated medical practice. Patients observing purdah resisted operations, some postponed surgeries at the last minute deeming the hour “inauspicious,” while others consulted village elders who determinedhe hospital became a sanctuary for women’s health, normalizing dental extractions, eye surgeries, and maternity care in a city where traditional practices often prevailed.The British contribution to Lucknow’s health system was profound. Alongside Lady Kinnaird Memorial Hospital, the Lady Dufferin Hospital was established in 1889 under the Countess of Dufferin Fund to provide safe maternity care. Later, the Queen Mary’s Hospital arose in the early 20th century as a centre for women’s medical education. Together, these institutions marked the colonial effort to embed Western medicine into the city’s fabric, particularly for women and children. In 1971, the site was absorbed into King George Medical College, now popularly known as KGMU, housing its neurosurgical and mental health departments. Today, its memory lingers only in archives and recollections, overshadowed by its contemporaries. Yet, its legacy remains unique – a Christian missionary hospital that combined philanthropy, medical progress, and social reform. A place where doctors braved not only disease but monkeys, snakes, and cultural resistance to bring care to the women of Lucknow. An institution that has produced some of the world’s finest medical professionals, researchers and administrators.
